1. Acceptance of Terms

These Terms of Service and End User License Agreement ("Terms") govern your use of the MacroMint mobile application (com.macromint.app) and any related services (collectively, the "App"), operated by MacroMint ("we," "us," or "our"). By creating an account or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms include, and incorporate by reference, our Privacy Policy, Health Disclaimer, and Subscription Terms.

2. Eligibility & Age Requirements

You must be at least 13 years old (or the applicable minimum digital consent age in your country — 16 in most EEA member states) to create an account. By registering you represent that you meet the minimum age requirement. If we discover that a user is below the minimum age, we will delete their account.

If you are under 18, you must have permission from a parent or legal guardian to use the App.

3. License Grant

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, solely for your personal, non-commercial nutritional tracking purposes.

You may not: (a) sublicense, sell, rent, lease, or transfer the App; (b) reverse engineer, decompile, or disassemble the App; (c) remove copyright or proprietary notices; (d) use the App for any commercial purpose without our written consent; or (e) circumvent any security measure.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information at registration and keep it up to date.
• You may not share your account with others or create accounts on behalf of third parties.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Health & Medical Disclaimer — Important

⚠ MacroMint is not a medical device and does not provide medical advice. Macro targets, body fat estimates, TDEE calculations, and recipe suggestions are informational tools only. They are not a substitute for advice from a licensed physician, dietitian, or other qualified healthcare professional. Always consult a qualified healthcare professional before making significant changes to your diet, exercise regime, or health plan.

Body composition formulas (Deurenberg, US Navy) used in the App are statistical estimates and may not be accurate for all individuals. AI-generated food estimates and recipes may contain errors — verify nutritional information against product labels for medical or dietary precision.

6. AI-Generated Content

The App uses Google Gemini AI to analyse food photos and generate recipes. You acknowledge that:

• AI-generated nutritional estimates are approximate and may not be accurate.
• AI-generated recipes do not account for food allergies, intolerances, or dietary restrictions unless you specify them.
• We are not responsible for harm arising from reliance on AI-generated content.
• You should verify AI outputs against product labels and consult a professional for dietary decisions with health implications.
• AI credits are consumed per AI request and are not refundable once used.

7. Subscriptions & Billing

MacroMint offers free and paid subscription tiers. Paid subscriptions are governed by the full Subscription Terms & Billing Policy. Key points:

• Subscriptions are billed through the Apple App Store or Google Play Store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• We do not process refunds directly — refund requests must be directed to Apple or Google.
• AI credits are consumed on a per-use basis and are not transferable between accounts.
• Features available under each subscription tier are described in the App and may change with reasonable notice.

8. FatSecret Attribution

Food nutrition data is powered by the FatSecret platform API. MacroMint uses the FatSecret database under licence and in compliance with FatSecret's Terms of Service. FatSecret is a trademark of Fatsecret Global IP Holdings, LLC.

9. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation.
• Interfere with the App's infrastructure or other users' access.
• Upload malicious content or attempt to access systems you are not authorised to access.
• Impersonate any person or entity.
• Use the App to promote disordered eating or provide unsolicited health advice to others.
• Attempt to reverse-engineer or extract the App's AI models or data.

10. Intellectual Property

The App and all its content (excluding user-generated data) — including the MacroMint name, logo, software, algorithms, and design — are the exclusive property of MacroMint and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your personal data (food logs, body metrics, photos). By using the App you grant us a limited, non-exclusive, royalty-free licence to process your data to provide the App's services. We do not claim ownership of your data.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• MacroMint is provided "as is" and "as available" without any warranty, express or implied.
• We disclaim all warranties of fitness for a particular purpose, accuracy, and non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total aggregate liability to you for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim (or €20 if you are a free user).
• Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless MacroMint and its officers, directors, employees, and agents from any claim, damage, loss, or expense (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third party's rights.

13. Termination

You may stop using the App and delete your account at any time via Settings → App Settings → Delete Account. We may suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your licence to use the App ends immediately. Sections 5, 6, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law & Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. For users in the EU/EEA, mandatory consumer protection laws of your country of residence also apply and are not affected by this choice of law.

Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us at legal@macromint.dev. If the dispute is not resolved within 30 days, it shall be submitted to binding arbitration in Ontario, Canada, under applicable arbitration rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. EU users may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance. If you do not agree to the updated Terms, delete your account before the effective date.

16. Apple App Store Additional Terms (EULA)

If you downloaded the App from the Apple App Store, the following additional terms apply:

• This EULA is between you and MacroMint, not Apple, Inc. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any product liability claims relating to the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the App purchase price (if any). Apple has no other warranty obligation.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
• You represent that you are not in a US-embargoed country and are not on any US government prohibited parties list.
